These General Terms and Conditions apply to the remote purchase of products and services via the website www.anbernic.games, owned by DM SOLUZIONI ICT s.r.l., with headquarters in Pescara (PE) at Via Lamarmora, 5. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, with regard to privacy protection, will be subject to the provisions of Law no. 675/96 and subsequent amendments.
Acceptance of the General Terms and Conditions of Sale
By electronically submitting the purchase order confirmation, the Customer unconditionally accepts and undertakes to comply with the following general terms and conditions of sale in their dealings with DM SOLUZIONI ICT s.r.l., hereinafter DM-ICT. They declare that they have read and accepted all the information provided pursuant to the aforementioned regulations. They also acknowledge that DM-ICT itself is not bound by any other terms and conditions unless previously agreed to in writing.
Customer Obligations
These General Terms and Conditions of Sale must be reviewed online by Customers visiting the website www.anbernic.games before confirming their purchases. Submitting an order confirmation therefore implies full knowledge of these General Terms and Conditions of Sale and their full acceptance.
The Customer undertakes, once the online purchase process has been completed, to print and retain these general terms and conditions of sale, which were reviewed and accepted during the purchase process, in order to fully satisfy the conditions set forth in Articles 3 and 4 of Legislative Decree No. 185/1999.
Purchase Procedures
www.anbernic.games is an online website that offers the opportunity to purchase IT products.
Products, available as illustrated and described online in the relevant product descriptions and specifications, are purchased by the Customer at the price indicated therein, to be confirmed upon order confirmation, plus shipping costs as specified below and displayed at the time of purchase.
Before confirming the purchase, the Customer will be shown a summary of the unit cost of each selected product and the total cost, including shipping costs.
Upon confirming the purchase, the customer will receive an email containing the total purchase amount, as a summary of the transaction.
Payments
Payment for the purchased products and shipping costs must be made by the customer upon submitting the order confirmation by bank transfer or through the PayPal online payment system.
Through PayPal, a global leader in secure online payments, we accept major credit cards and PayPal account payments. A PayPal account or credit card is the most convenient and cost-effective payment method, and is chosen by DM-ICT to optimize order processing times.
The transaction takes place online using PayPal's secure systems, and no credit card information is transferred to DM-ICT. Order data is encrypted using the SSL (Secure Socket Layer) system and transmitted directly to PayPal's servers, ensuring data transmission security in accordance with current regulations.
Product Delivery
Purchased products will be delivered to the address indicated by the customer. Each shipment contains the ordered goods and the shipping document or, alternatively, the accompanying invoice. Product deliveries will be made on all business days. Product deliveries may be split, without this incurring any liability for DM-ICT.
Shipping is via express courier, usually SDA or UPS. Before collecting the product, the customer is required to verify that the package is intact, undamaged, and not wet.
Warranty and Defective Products
Products purchased through the website www.anbernic.games are subject to the provisions, where applicable, of Legislative Decree No. 24 of February 2, 2002 (Official Gazette No. 57, March 8, 2002) on sales contracts and warranties for consumer goods and, for anything not covered therein, to the specific provisions of the Italian Civil Code.
This warranty applies to products with defects and/or malfunctions that were not detectable at the time of purchase, provided that the product is used correctly and with due diligence, i.e., in accordance with its intended purpose and as provided in any technical documentation, in compliance with the various operating instructions indicated therein.
The aforementioned warranty does not apply in the event of negligence or careless use and maintenance of the product, or in the event of connection of the purchased product to electrical systems or any other type of non-compliant connection. The warranty is personal and applies only to the original purchaser, being reserved for direct customers and not to merchants, resellers, etc.
Any product malfunction must be reported within fourteen (14) days of receiving the goods. The customer must include a written notification when returning the defective product.
Even if the product is defective, to be eligible for replacement, it must be returned complete with its packaging, all accessories, and any documentation received by the customer at the time of purchase. Returning the product without the original packaging, accessories, and any aforementioned documentation will prevent DM-ICT from replacing it.

DM-ICT reserves the right to verify the actual defect reported by the customer and only replace the item after such inspection.
The request will be processed only if, in addition to the defective item, the following documents are included in the returned package: the shipping document or invoice for the item and a brief description of the defect, specifying the context in which the product was used.
Right of Withdrawal
Pursuant to Article 64 et seq. of Legislative Decree No. 206/2005, if the Customer is a consumer (i.e., a natural person who purchases the goods for purposes not related to their professional activity, or who does not indicate a VAT number on the order form), they have the right to withdraw from the purchase contract for any reason, without penalty and without prejudice to the provisions set forth in the following paragraphs.
Purchases made on the website www.foscamitalia.it are governed by Italian law on mail order sales. If you made a mistake in your order and received an unwanted item, you have 14 days from the delivery date to exercise your right of withdrawal, meaning you can return the product. We will accept the return of any item without hesitation, provided it is in perfect condition, and will refund the full amount (excluding packaging and shipping costs).

Jurisdiction and Competent Court
This contract will be governed by Italian law. Any dispute concerning the validity, interpretation, or performance of this contract will be subject to the exclusive jurisdiction of the courts of the consumer's place of residence or domicile, if located within the Italian territory.
